Kadına Yönelik Şiddetin Tarihçesi
Özet
Bu çalışma, kadına yönelik şiddetin patrikaryal toplum yapısı ve mülkiyet ilişkileri içerisinde nasıl kurumsal bir hale getirildiğini tarihsel bir bakış açısıyla incelemeyi amaçlamaktadır. Bu sebeple kadın bedeninin antik çağdan başlayarak Mezopotamya, Antik Yunan ve Roma uygarlıklarında hukuki düzenlemeler ve sosyo-kültürel normlar aracılığıyla nasıl denetim altına alındığı; şiddetin nasıl kabul edilebilir bir hale getirildiği tartışılmaktadır. Mezopotamya hukukunda kadının konumu, Antik Yunan’da kadının kamusal alandan uzak tutuluşu ve Roma hukukunda işlevsel olan patria potestas kavramı, şiddetin meşru kılınmasında etkisi olan örnekler olarak ele alınmaktadır. Çalışma, Orta Çağ feodal düzeninin kadın bireye uyguladığı baskıyı ve Osmanlı döneminde şer’î hukuk, töre ve aile yapısı desteğinin kadına yönelik şiddet üzerindeki rolünü irdelemektedir. Modern döneme gelindiğinde ise 20. yüzyılın ilk yarısında hukuki dönüşümlerle birlikte aile içi şiddetin “özel alan”dan çıkarak bir “kamu sorunu”na dönüşme süreci incelenmektedir. Sonuç olarak çalışma, kadına yönelik şiddetin tarihsel sürekliliğini ortaya koyarak, şiddet ile mücadele için günümüzde yapılabilecekler adına tarihsel bir farkındalık zemini sunmayı hedeflemektedir.
This study aims to examine, from a historical perspective, how violence against women has been institutionalized within the patriarchal social structure and property relations. For this reason, there is debate about how women's bodies have been controlled through legal regulations and socio-cultural norms in Mesopotamia, Ancient Greece and Roman civilisations since ancient times, and how violence has been made acceptable. The status of women in Mesopotamian law, the exclusion of women from public life in Ancient Greece, and the concept of patria potestas, which was functional in Roman law, are examined as examples that contributed to the legitimisation of violence. The study examines the oppression of women under the medieval feudal system and the role of Islamic law, customery norms and family structure in the Ottoman period in relation to violence against women. In the modern era, the process by which domestic violence emerged from the ‘private sphere’ to become a ‘public issue’ alongside legal transformations in the first half of the 20th century is examined. In conclusion, the study aims to reveal the historical continuity of violence against women and to provide a historical awareness foundation for what can be done today to combat violence.
