Doğum bakımında insan haklarının aşamalı olarak anlaşılması: Bireysel haklardan sistemsel sorunlara
Özet
Doğum bakımında insan hakları, bireysel istismar ve saygısızlık konularından sistemsel ve kültürel sorunların çözümüne doğru aşamalı bir gelişim göstermektedir. Bugüne kadar süreç daha çok medeni ve siyasi haklar ile özerklik, haysiyet, eşitlik ilkeleri üzerinden ilerlemiş; özellikle Güney Amerika’da obstetrik şiddet kavramı ve kanunları geliştirilmiştir. Avrupa İnsan Hakları Sözleşmesi'nin 8. maddesi kapsamında doğum koşullarını seçme hakkı mahkemelerde merkezi odak noktası olmuştur. Ancak sağlık hakkı ile bilimsel ilerlemeden yararlanma hakkı gibi ekonomik, sosyal ve kültürel haklar doğum sistemlerinde henüz tam olarak keşfedilmemiştir. Sağlık hakkı çerçevesinde devletlerin, kullanılabilirlik, erişilebilirlik, kabul edilebilirlik ve kalite (AAAQ) standartlarında, ulaşılabilir en yüksek fiziksel ve zihinsel sağlık standardını sağlaması gerekmektedir. Birleşik Krallık’taki Birthrights kuruluşu ise ücretsiz hukuki danışmanlık, kampanyalar, medya faaliyetleri ve sağlık çalışanlarına yönelik eğitimleri içeren dairesel bir örgütsel model geliştirerek insan hakları dilini sistemsel politikaları ve ebelik denetim modellerini (A-EQUIP) olumlu yönde etkilemek için kullanmaktadır. Sonuç olarak insan hakları yaklaşımı, doğum süreçlerinde tüm kadınlara değerli ve özerk bireyler olarak yaklaşılan; güvenli, şefkatli ve kanıta dayalı bir bakım kültürünün yerleşmesini amaçlamaktadır.
Human rights in childbirth care show a progressive development from individual abuse and disrespect toward resolving systemic and cultural issues. Until now, the process has mostly proceeded through civil and political rights alongside principles of autonomy, dignity, and equality; particularly in South America, the concept and laws of obstetric violence have been developed. Under Article 8 of the European Convention on Human Rights, the right to choose childbirth conditions has been the central focus in courts. However, economic, social, and cultural rights such as the right to health and the right to benefit from scientific progress have not yet been fully explored in childbirth systems. Within the framework of the right to health, states are required to provide the highest attainable standard of physical and mental health in line with availability, accessibility, acceptability, and quality (AAAQ) standards. The Birthrights organization in the United Kingdom has developed a circular organizational model comprising free legal advice, campaigns, media activities, and training for healthcare professionals, utilizing the language of human rights to positively influence systemic policies and midwifery supervision models (A-EQUIP). Consequently, the human rights approach aims to establish a safe, compassionate, and evidence-based care culture in childbirth processes where all women are treated as valued and autonomous individuals.
