Osmanlı Yargı Kararları (Anlama ve Yorumlama İlkeleri)

Bu kitap, Osmanlı mahkemelerinde verilen yargı kararlarının anlama ve yorumlama ilkelerini ele almaktadır. Yazar, Osmanlı Devleti'nin hüküm sürdüğü dönemde mahkeme kayıtlarının titizlikle tutulduğunu ve bu kayıtların günümüze kadar ulaştığını belirtmektedir. Osmanlı mahkemelerinde tutulan defterlerdeki kayıtlar, İslam hukukçularının belirlediği usul ve yöntemlere göre kaydedilmiştir. Bu eser, mahkeme kayıtlarının nasıl yazılması gerektiği konusunda kadılara rehberlik etmiştir. Ancak Osmanlı Devleti'nin sona ermesiyle birlikte, kadı defterlerinin anlaşılması ve yorumlanması ihtiyacı ortaya çıkmıştır. Bu çalışma, mahkeme kayıtlarının yorumlanmasına yardımcı olacak ilkelerin belirlenmesini amaçlamaktadır. Yazar, çalışmasında Prof. Dr. Nasi Aslan'ın fikirlerinden ve diğer mesai arkadaşlarının katkılarından bahsetmektedir.

This book examines the principles of understanding and interpreting judicial decisions in Ottoman courts. The author states that during the period of Ottoman rule, court records were meticulously kept and have survived to the present day. The records in the Ottoman court registers were recorded according to the methods and principles determined by Islamic jurists. This work served as a guide for judges on how court records should be written. However, with the end of the Ottoman Empire, the need arose to understand and interpret the kadı registers. This study aims to determine the principles that will assist in the interpretation of court records. The author mentions the ideas of Prof. Dr. Nasi Aslan and the contributions of other colleagues in his work.
