İslam Hukukunda Eğitim ve Öğretim Hakkı

Bu çalışmada, İslam hukuku perspektifinden eğitim ve öğretim hakkı incelenmiştir. Eğitim ve öğretim, toplumların gelişimi ve refahı için önemli bir yatırım olarak kabul edilmektedir. İslam dini, eğitim faaliyetlerinin düzenlenmesi ve etkin bir şekilde gerçekleştirilmesi için yöneticilere ve sorumlulara bazı düzenlemeler yapmayı ve teşvikler sağlamayı öngörmüştür. Günümüzde eğitim, bilim alanında da büyük ilerlemeler kaydetmektedir ve eğitim hukuku bağımsız bir bilim dalı olarak kabul edilmektedir. Eğitim hukuku, ulusal yasalarda olduğu kadar uluslararası sözleşme ve belgelerde de yer almaktadır. Eğitim hakkı, temel bir insan hakkı olarak kabul edilmekte ve ihlali uluslararası bir sorun olarak değerlendirilmektedir. Çalışmada, eğitim hakkının tarihsel gelişimi ve amaçları incelenmiş, insanların eğitim ihtiyacı psikolojik ve sosyolojik açıdan araştırılmış ve İslam Hukukunun temel kaynaklarına göre eğitimin gerekliliği değerlendirilmiştir. Ayrıca, her Müslüman için zorunlu olan temel eğitim düzeyi tartışılmıştır.

In this study, the right to education and teaching has been examined from the perspective of Islamic law. Education and teaching are considered as important investments for the development and welfare of societies. The Islamic religion has envisaged making certain regulations and providing incentives to administrators and responsible parties for the organization and effective implementation of educational activities. Nowadays, education is also making significant progress in the field of science, and education law is recognized as an independent branch of science. Education law is included not only in national laws but also in international treaties and documents. The right to education is considered as a fundamental human right and its violation is regarded as an international issue. In this study, the historical development and objectives of the right to education have been examined, the educational needs of individuals have been investigated from psychological and sociological perspectives, and the necessity of education has been evaluated according to the fundamental sources of Islamic law. Additionally, the discussion on the compulsory basic education level for every Muslim has been addressed.
